RELEASE AND WAIVER - 1/1/2022 This Release and Waiver must be signed by all participants, or by their parent(s) or guardian(s) if the participant is a minor, who voluntarily choose to participate in any fitness activity, class, session, clinic, camp, or event connected with and/or located on the property of, or in any building owned by, Hernando Methodist Church (hereinafter “HMC”) and Brown Missionary Baptist Church (hereinafter "BMBC" & Grace Volleyball. This specifically includes all activities that occur in the areas of the church commonly referred to as the “Fitness Room” and “Gym.” The undersigned or listed participant agrees as follows, to-wit: 1. That I will inspect the mats, equipment, facilities, and if I believe anything is unsafe or beyond my capability, I will immediately advise my instructor, or supervisor of such condition(s) and refuse to participate. 2. That I acknowledge and fully understand that I will be engaging in activities that might result in serious injury, and social and economic loss due to not only my own actions, inactions or negligence, but also the action, inaction, or negligence of others. Further, I acknowledge that there may be other risks not known to me or not reasonably foreseeable at this time. 3. That I assume all risks involved in the activities to which I participate. 4. That all participation by me in any physical activity is entirely on my own free will and understand the importance of following rules set down by my instructor, coaches and other officials. 5. That I am in good physical condition and have no disease, injury, or other condition that would impair my performance of physical activities. 6. Should my child(ren) and/or I become ill or injured while participating in any physical activity while on the premises of HMC or BMBC, I give permission and hereby grant the authority for HMC & BMBC staff members, or trainers, or coaches, or chaperones, or volunteers, to: (a) Render first-aid emergency treatment, and /or; (b) To obtain emergency care for my child(ren) and/or myself, and/or; (c) To obtain the medical attention they may deem necessary for my child(ren) and/or myself. 7. I hereby release and covenant not-to-sue and agree to indemnify HMC,BMBC, Grace Volleyball and/or the officers and/or owners, their members, staff, volunteers, Board of Directors, or agents, from any and all present and future claims resulting from ordinary negligence on the part of HMC, BMBC, and Grace Volleyball. Furthermore, I hereby release and covenant not-to-sue and agree to indemnify HMC, BMBC, and Grace Volleyball, and/or the officers and/or owners, their members, staff, volunteers, Board of Directors, or agents, for any property damage, personal injury, or wrongful death, arising as a result of engaging or receiving instruction in physical activities, or any other activities or any activities incidental thereto, wherever, whenever, or however the same may occur. I hereby voluntarily waive any and all claims resulting from ordinary negligence, both present and future, that may be made by me or my agents or representatives. 8. In case of a minor; I/We the parent(s) or legal guardian(s) of this minor participant have instructed or will instruct the minor participant to the above warning and conditions and their ramifications, and I/We additionally confirm and agree to all of the above statements, conditions, waivers, and releases, and consent to this minor’s participation. 9. I, an adult (as defined by state and local laws), do hereby agree to all conditions, and their ramifications, and I additionally confirm and agree to all of the above statements, conditions, waivers, and releases, and consent to train under the above conditions. I/WE HAVE READ THE ABOVE WARNING, WAIVER AND RELEASE, UNDERSTAND THAT I/WE GIVE UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND KNOWING THIS, SIGN IT VOLUNTARILY.
